A cell phone or distracted driving citation in California can add a point to your driving record, raise your insurance, and incurs court costs in addition to the fine. For commercial drivers, even one "reportable" conviction can threaten a CDL. Many citations are eligible for dismissal — but only where defects on the written citation are properly raised and the court agrees. We do not guarantee any dismissal.
What we check on your citation
- Legal basis for the stop — whether the officer had grounds to pull you over in the first place.
- The cited section — VC 23123 (hand-held) vs. 23123.5 (teen), 23124, or "distracted driving" — the wrong section is a common error.
- What the officer observed — a credible, unobstructed view of the specific violation is required.
- Device-in-hand distinction — using a phone for navigation or mounted use is legal in some circumstances.
- Citation completeness — the officer and device blocks must be complete and legible.
